INTRODUCTION
1.1 Background to the Study
In political science One of the most important pieces of legislation that was enacted in Nigeria in 2011 and that has greatly contributed to transparency, accountability, and democracy in the nation is the Freedom of Information Act (FOIA). According to the Act, citizens have the right to access information from public agencies, except when such access would jeopardize national security or any other interest protected by law. Before the establishment of the Act, information regarding matters of the government was limited. As a result, it became hard for individuals like members of the civil society organizations, researchers, journalists, and citizens to carry out their supervision of government institutions. Hence, the adoption of the FOIA Act becomes another important landmark in the democratic process of Nigeria (Freedom of Information Act, 2011).
Accountability is one of the main pillars of democratic governance. The concept of accountability entails answering for one’s deeds, decision-making process, and utilization of resources in the process of governance. Accountability leads to transparency, decreased corruption levels, effective public services delivery, and increase in public trust in government agencies. Access to information in democratic countries is among the major ways that citizens can judge the performance of the government (United Nations Educational, Scientific and Cultural Organization [UNESCO], 2023).
Since the Freedom of Information Act (FOIA) was enacted, many Public Institutions in Nigeria have taken steps to increase information disclosure and to comply with requests from citizens. The Act has been an important tool for Investigative Journalists and Civil Society Organizations to access official documents for public expenditures, procurement processes, policy implementation, and institutional performance. These initiatives have helped uncover corruption cases, financial mismanagement, and abuse of public office, and have also led to a culture of greater transparency in government institutions (Ovey et al., 2025).
However, despite these successes, the implementation of the Freedom of Information Act still poses various problems. There are several instances where public bodies do not reply to information requests in time or simply deny access to requested information without adequate legal grounds. Poor record-keeping practices, lack of awareness among public bodies, bureaucratic obstacles, and inefficiency of enforcement have resulted in failure of implementing the law in certain situations. Implementation problems have reduced the effectiveness of the law in achieving its goals (Bamgbose et al., 2025).
In recent times, there have been many studies which have shown that despite the FOIA improving democratic governance through empowering the people and the press, its full benefits have not been attained because of existing weaknesses within the institution and poor compliance from governmental bodies. In this regard, Dickson et al. (2025) state that the full implementation of the Act is crucial for the consolidation of democracy as transparency increases trust and citizen involvement in governance. In a similar vein, Benson (2025) found that compliance of the Act differs greatly between different institutions of government.
Given that there is an increasing demand for transparency in Nigeria, especially in the administration of public finances and policies, the need to evaluate the effectiveness of the Freedom of Information Act is becoming more important than ever before. In light of the citizens' increasing expectations for accountability by those in power, it is crucial to examine the strengths and weaknesses of the Act.
1.2 Statement of the Problem
Although the Freedom of Information Act was created in an attempt to increase transparency and accountability in government bodies, its execution has proved to be quite controversial. A little over ten years since its creation, numerous government organizations still show inadequate adherence to public requests for information. Delays in the provision of information are often accompanied by refusals of access to information which cannot be justified legally..
The continued existence of corruption, lack of financial accountability, and lack of transparency in some public institutions is a problem that calls into question the true efficiency of the Freedom of Information Act in meeting its objectives. Lack of awareness about the stipulations contained in the Act among citizens and public officials has also meant that it has been under-utilized as a means of ensuring accountability..
While there have been several studies carried out on the legality of the FOIA, very few studies have been done recently on the effectiveness of the FOIA in ensuring government accountability in the face of the current democratic state in Nigeria. This research will therefore be aimed at investigating the extent of improvement of government accountability through the implementation of the FOIA in Nigeria..
1.3 Aim of the Study
The main aim of this study is to examine the effectiveness of the Freedom of Information Act in promoting government accountability in Nigeria.
1.4 Objectives of the Study
The specific objectives are to:
1. To what degree has the Freedom of Information Act led to government accountability in Nigeria?
2. Analyze how public institutions have complied with the Freedom of Information Act.
3. What are the top challenges hindering the implementation of the Freedom of Information Act in Nigeria?
4. Suggest measures that may improve the ability of the Act to enhance transparency and accountability.
1.5 Research Questions
The study is meant to address the following research questions:
1. To what degree has the Freedom of Information Act improved accountability within the government of Nigeria?
2. To what degree do public organizations comply with the provisions set out in the Freedom of Information Act?
3. Which obstacles stand in the way of successful implementation of the Freedom of Information Act?
4. How can the effectiveness of the Freedom of Information Act be improved?
1.6 Significance of the Study
This research shall add to the existing literature about transparency, accountability and governance in Nigeria. The study is going to help policy makers, legislature, anti-corruption bodies, non-governmental organizations, journalists, researchers, and students of Political Science.
The research findings shall help government bodies to identify the shortcomings in the implementation of the Freedom of Information Act and devise ways through which it can be improved. Non-governmental organizations and media houses can gain from this research because of the importance of access to information in ensuring public accountability.
Academically, this research is going to form a useful source for researchers who will conduct their research in future in areas such as public administration, governance, transparency and corruption studies.
1.7 Scope of the Study
The research will assess the effectiveness of the Freedom of Information Act in enhancing government accountability in Nigeria. In particular, the research will look at how the Act has been implemented by the public agencies, its contributions towards accountability and transparency, as well as the problems that hinder its effectiveness. The research will be confined to Nigeria, covering events from the introduction of the Act in 2011 to those in 2025.
1.8 Operational Definition of Terms
Freedom of Information Act (FOIA): This is a law in Nigeria that was established in 2011 giving Nigerians the right to have access to information in public institutions as per stated exemptions.
Government Accountability: It refers to the duty of the public official or government institution to account for its actions, decisions, and how it uses the resources at hand.
Transparency: This involves the openness of the government institution in making available truthful information on its operations, decision-making process, and financial transactions.
Public Institution: It is any government ministry, department, or agency covered by the Freedom of Information Act.
